See the six steps for thisIf your business holds private information about New York residents – customers, patients, or your own staff – the NY SHIELD Act already applies to you, and has since 2020. If they are Florida residents, the Florida Information Protection Act does the same, with a thirty-day clock on breach notice. Most of the businesses we meet have never heard of it.
It requires reasonable administrative, technical and physical safeguards. It does not hand you a checklist, which is exactly what makes it awkward: there is no certificate to earn and no auditor to pass, only the question of whether what you had in place was reasonable – asked, usually, after something has already gone wrong. Florida’s Act is built the same way, and adds a deadline: thirty days to notify the people affected.
